The Board considered a report of the
Corporate Director, Chief Executive’s Delivery Unit, that detailed the
Council's position on settlement agreements which are used in exceptional
circumstance.
It was noted that where the need to
use a settlement agreement was required, the legal framework set out in Section
111A of the Employment Rights Act 1996, and the guidance for Best Value
authorities on Special Severance Payments, as set out in Section 26 of the
Local Government Act 1999, would be discharged appropriately. In the event that
a settlement agreement was considered appropriate for a position appointed to
by the Council’s Appointment Committee, discussions would take place between
the Chief Executive, Leader and the appropriate Executive Board Portfolio
Holder and a decision would made to use such an agreement for that position.
Arising from the discussion, it was
agreed that consideration would be given by Officers to how information on
future settlement agreements could potentially be shared with Councillors.
