1.

APPLICATION FOR A PREMIER LICENCE AT JJS GENERAL STORE 87 FREDERICK STREET, WIDNES

Minutes:

The Committee considered an application which had been made under Section 17 of the Licensing Act 2003 for a premises licence in relation to the above property.

 

The hearing was held in accordance with the provisions of Section 18 Licensing Act 2003 and the Licensing act 2003 (Hearings) Regulations 2005.

 

The applicant Jegatheeswaran Sangaranarayanapillai was represented by Mr Morris (EAD Solicitors).  As part of the representations Mr Morris confirmed that his client accepted all of the conditions requested by Cheshire Constabulary.  In addition the applicant agreed two further conditions to be attached to the premises licence as set out at ‘Conditions agreed at the Hearing’ below.

 

Mr B Karalius made oral representation objecting to the application on behalf of the interested parties.  150 letters of objection were received from residents in the vicinity of the premises.  In addition Councillor Horabin made oral representation on behalf of local residents.

 

Following the hearing the Committee retired to consider the application and all the relevant representations

 

RESOLVED: That   having   considered   the   application   in accordance with section 4 Licensing Act 2003 and all other relevant considerations it is decided that the application be granted.

 

Reason

 

It is considered that the application is consistent with the licensing objectives.

 

For the avoidance of doubt it is now recorded that the applicant agreed to the following conditions with the Cheshire Constabulary, which shall be deemed to be added to the operating schedule and be conditions of the licence:

 

Proof of Age / Challenge 21

 

The licence holder shall ensure that anyone who appears to be under 21 years of age and who attempts to purchase alcohol will be asked to prove their age. Accepted methods of proof of age are: passports, photo driving licences and PASS accredited proof of age cards e.g. Validate, Connexions, Citizen Card, Prove It Card. If any such person fails to satisfy the licence holder by means of such proof of age that they are 18 years old or older that person shall be refused the sale of alcohol

Staffing Levels

 

To afford a level of protection and security for staff there must never be less than two members of staff on duty at any given time.

Storage/Display

 

All spirits must be displayed behind the counter where they can only be accessed by staff, and not offered for self-service.

Conditions agreed at the hearing

 

The applicant agreed to the following conditions at the hearing  which shall be deemed to be added to the operating schedule and be conditions of the licence:

 

The sale of alcohol shall be ancillary to the sale of non-alcoholic goods at the premises.

APPLICATION TO VARY DESIGNATED PREMISES SUPERVISOR (DPS) AT THE RED ADMIRAL PUBLIC HOUSE, RUNCORN

Minutes:

            The above application was withdrawn by the applicant prior to the meeting.
