Members are reminded of their responsibility to declare any Disclosable Pecuniary Interest or Other Disclosable Interest which they have in any item of business on the agenda, no later than when that item is reached or as soon as the interest becomes apparent and, with Disclosable Pecuniary interests, to leave the meeting during any discussion or voting on the item.

Notice is hereby given that under Regulation 11 of the above, Councillor Woolfall, as Chair of the Environment and Regeneration Policy and Performance Board, has agreed to the above item of business being considered as a Key decision item not included in the Forward Plan, as the item of business is considered urgent and cannot reasonable be deferred for the reason stated below:

REASON:

Approval is needed as there is an urgent need to introduce an article 4 directive to promote quality standards in homes in the Borough.

PART II

In this case the Board has a discretion to exclude the press and public and, in view of the nature of the business to be transacted, it is RECOMMENDED that under Section 100A(4) of the Local Government Act 1972, having been satisfied that in all the circumstances of the case the public interest in maintaining the exemption outweighs the public interest in disclosing the information, the press and public be excluded from the meeting for the following item(s) of business on the grounds that it involves the likely disclosure of exempt information as defined in paragraph 3 of Part 1 of Schedule 12A to the Act.

Reason for taking the item in Part II:

The public interest in not disclosing is the report and supplementary information contain confidentially sensitive information regarding future options for the service, which outweighs the public interest in the decision.

The public interest in maintaining the exemption outweighs the public interest in disclosing the information given it relates to information relating to employee consultation and/or Trade Union negotiations

Approval is needed urgently for Officers to finalise the legal and financial arrangements for a loan agreement and for due diligence to be undertaken.
